Introduction

We must admit, we're not fans of "legalese" because we believe that correct and fair behavior should be the touchstone for determining what can and cannot be done. Granted, we know that people have different perspectives on these matters, hence this document to clarify what's necessary.

Scope

These terms and conditions govern the use of the Happonomy site and related online entities such as apps. By using the website or application, you agree – without any reservation – to these terms and conditions.

If you disagree with any of the elements, please do not use our site or application.

Intellectual Property

Unless otherwise stated, Happonomy owns the intellectual property of this website and the materials on the website. In other words, all intellectual property is reserved to Happonomy. That said, we provide an open license to use the content created under the following conditions:

First and foremost, a distinction must be made between articles and creative items (photos, video, audio...). There is a rule and an exception to the rule for each of these categories.

1. Written articles

The rule: you may take, download and reuse articles or parts of articles from the website for personal use or for educational purposes. Commercial reprinting (reprinting by companies or non-profits that charge money for this content) is not permitted without written permission from Happonomy.

The exception: If the author of an article decides to deviate from this rule – often by making the rules stricter – this is indicated at the bottom of the article.

2. Creative items

The rule: We work under a creative commons license that allows you to share, copy and redistribute materials.

You can also remix, rework or further develop the materials. You may not use the material for commercial purposes unless prior written permission has been obtained.

If you adapt the material, you must release your work under the same conditions. You must also give appropriate 'credit' to the original performer and indicate that changes have been made. You must do this in an appropriate manner and in no way suggest that the original performer endorses you or your use.

We place one limitation on the absolute freedom to rework material. The reworkings should be respectful to other people and build on a 'positive worldview'. If we find items offensive, we reserve the right to remove materials. This is not intended to practice censorship, but we want to be sure that the core of Happonomy remains clear and pure.

Privacy

We know that privacy means a lot to one person and very little to someone else. That's why we strive for a maximum number of control options so that you can determine how we can or cannot use your data. Our intention is to support you maximally in fulfilling the needs in your life. That's also why we need to get to know you if we want to do our work well. We are a non-profit and we have no need to make money from your data, on the contrary.

In other words, it's up to you to determine how much you trust us. We know that building trust takes time and is quickly lost. We can only promise you that we will do our utmost not to damage it. We hope the same from you.

You can count on us to:

• Not sell or rent your data.
• Not share your data without your explicit consent.
• Protect your data to the best of our technical knowledge.
• Permanently delete your data if requested (email us at hello@happonomy.org) No hidden storage moments, no difficult procedures.
• Only enrich your data if it is directly useful to improve the quality of the service we can provide to you. That service must relate back to the dimensions of quality of life that you find in the Happonomy model.

Acceptable use

This should be clear...

You may not use the Happonomy website or application(s) in a way that (potentially) damages the site or application, compromises availability or negatively impacts its security. That you do not use the website, application and other items in a way that is illegal, fraudulent or harmful goes without saying.

You cannot copy the website itself, send, or distribute materials through the site or application that are considered spyware, viruses, Trojan horses, keyloggers, rootkits or any other software that is not kosher.

You cannot perform systematic or automatic data collection activities (including scraping, data mining, data extraction and harvesting) without our prior written consent.

Access restrictions

Access to certain parts of the site is restricted. Happonomy reserves the right to restrict parts of the site or the entire site at its own discretion.

Happonomy may delete your user ID and password without permission or explanation from other parties, including yourself. Should this occur, we strive to clarify the context around this afterwards.

Submitting your own content

In these terms and conditions, 'user content' means materials (including without limitation text, images, audio files, video).

You grant Happonomy a worldwide, permanent, non-exclusive royalty-free license to use, adapt, publish, translate and distribute the material in existing or new media. You also grant Happonomy the right to sublicense these rights and to legally pursue any infringements.

Your user content may not be illegal or unlawful, may not harm the rights of third parties and may not be the cause of any legal action against yourself, Happonomy or any other party. You may not submit user content that has brought or brings any complaint or legal prosecution today or in the past.

Happonomy reserves the right to edit, not publish or remove all user content.

No "warranty"

The website is made available "as is" without any warranties, implicit or explicit. Without prejudice to the generality of the application of this clause, Happonomy gives no warranty that:

• This website or related apps are available at all times.
• The information on this website is 100% accurate, complete or true. That said, we do our utmost to maintain an unbiased perspective, but due to the nature of the topics on the site, we cannot offer guarantees of 100% accuracy.
• Nothing on this website should be understood as advice in any form whatsoever. If you need advice regarding legal, financial or medical matters, do yourself a favor and consult an appropriate professional for this.

Limitations of liability

Happonomy is not liable (regardless of contractual or general liability) with regard to the content, use or other form of deployment of this website:

• for any indirect, consequential or special damage.
• for business losses, loss of income, profit or future savings, loss of contracts or business relationships, impact on reputation or goodwill, or damage caused by data corruption or loss.

These liability limitations also apply if Happonomy has been expressly informed of the possible loss.

Exception

Nothing in these terms and conditions will override the legally required liability rules. We play by the rules.

Reasonableness

By using this website, you agree to these limitations and find these limitations reasonable. If you don't, please don't use the site or other apps.

Other parties

You accept that Happonomy, as an entity with limited liability, has an interest in limiting the liability of its employees, directors. You agree not to bring any claim against the employees, directors of Happonomy regarding any damage related to the website or apps. You agree to the limitations as set out in these terms and conditions and that they relate to the liability of the employees, directors.

Invalid clauses

Should a clause from these terms and conditions not be enforceable or valid under applicable law, this will not affect the enforceability and validity of the other clauses from these terms and conditions.

Indemnification

You agree to indemnify Happonomy from any damage, costs, losses and liability claims (withoutany limitation also the legal costs that must be made and any amounts that must be paid to settle a claim) arising from any breach by you of any part of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to the rights granted to Happonomy, if you breach these terms and conditions, you know that Happonomy has the right to take appropriate action to address this breach, including suspension of your account, blocking computers using your IP address, contacting your ISP and taking legal action to prosecute this breach.

Modification

Happonomy may modify these terms and conditions. Revised terms and conditions will apply from the date of publication of these revised terms on the website. Please check regularly, we will also inform you when new terms are in use.

Agreement

These terms and conditions, combined with any more specific terms, form the basis for the use of the website and application and replace previous agreements or arrangements.

Law and jurisdiction

These terms and conditions are governed by Belgian law and all disputes will be handled by Belgian courts.
